Chain Provision
Traceability requirements in the global textile trade demand that suppliers verify the geographic source of their raw materials. The origin liability clause defines the legal responsibility of the mill to guarantee that the flax used in the yarn or fabric was grown and processed in the declared country of origin. This provision is designed to protect both the importer and the final brand from regulatory penalties and trade sanctions.
Compliance Verification
Verification of origin is accomplished through a combination of chain of custody documentation, farm-level certificates and physical testing of the flax fibres. Under the origin liability clause, the supplier must maintain detailed records of the purchase, transport and processing of the flax from the cultivation site to the spinning mill. If customs authorities or third-party auditors find that the flax originated from a prohibited region or was mislabeled, the supplier is held fully liable for the resulting costs.
These costs can include the impounding of the shipment, fines imposed by customs agencies and the loss of export privileges.
Legal Indemnity
Importers must protect their business operations from the reputational and financial damage of trade compliance violations. The origin liability clause provides a mechanism for the importer to shift all legal and financial consequences of false origin declarations back to the spinning or weaving mill. This shifts the burden of proof and the financial risk to the party that actually sourced the raw flax.
