Tariff Enforcement
Retrospective assessments are issued by government authorities when subsequent audits reveal that imported raw materials were ineligible for duty exemptions. A duty recovery demand is triggered if a linen mill cannot prove that its imported flax was used to manufacture exported fabrics. This action requires the mill to pay the original import tariffs plus interest and penalties on the disputed flax shipments.
Reconciliation Process
Customs officers review the mill inventory logs and the export shipping bills to trace the flow of goods. The duty recovery demand specifies the exact amount of unpaid tariff and the specific import declarations that are being reassessed. To dispute this charge, the mill must present signed bills of lading, yarn yield records, and waste disposal receipts.
These documents are submitted to the regional customs tribunal for formal review.
Liability Termination
Legal obligation to pay the assessed duties is lifted only after the customs authority issues a formal clearance letter or the tribunal rules in favor of the importer. The liability termination occurs once the mill presents the required proof of export or pays the settled amount. It ceases to apply to a specific import batch after the statutory limitation period has expired.
